Terms of Service

Last updated October 17, 2026

These Terms of Service ("Terms") form a binding agreement between you and The Factual Library ("we", "us" or "our") governing your access to and use of our website and services, including AI chat, image and video generation, the file manager, the community feed, showcase, marketplace and notepads (together, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of entering a binding contract. You agree to provide accurate registration information and to keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may require administrator approval before an account is activated, and we may limit or withhold access to particular features on a per-account basis.

2. The Service and AI-generated output

The Service enables you to submit prompts and files to third-party AI models and to receive generated text, code, images and video ("Output"). Output is generated automatically and may be inaccurate, incomplete, insecure, offensive or similar to output produced for other users. Output, including generated code, is not professional advice. You are solely responsible for reviewing, testing and validating Output before relying on or deploying it, and for determining whether Output may be used for your purpose.

3. Acceptable use

You agree not to, and not to permit others to:

We may review reported content, remove or restrict content, and suspend or terminate accounts that we reasonably believe violate this section.

4. Tokens, payments and billing

Use of chat, image generation and video generation is metered in tokens. Tokens are prepaid, are priced in Indian rupees at the rates displayed at checkout, and are consumed according to the model used, the size of the input and output, and the published cost of each generation. Payments are processed by a third-party payment processor, and you authorize us and our processor to charge the payment method you provide. Purchased tokens are credited to your balance after the payment has been verified and, where applicable, approved by us. Tokens do not expire, have no cash value, are not transferable between accounts and are not redeemable for money except where required by law. A generation that fails is not charged. Because AI requests incur costs when they are submitted, tokens consumed by completed requests are not refundable. We may correct balance errors, reverse fraudulent or charged-back transactions, and change prices or token rates prospectively on notice posted to the Service. Taxes, where applicable, are your responsibility. We may offer a limited number of free trial chats, which we may modify or withdraw at any time.

5. Your content and licenses

As between you and us, you retain whatever rights you hold in the prompts, files and other content you submit ("Your Content"), and, to the extent permitted by law and by the terms of the relevant AI provider, we assign to you any rights we may hold in the Output generated for you. Output may not be eligible for copyright protection in some jurisdictions. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, reproduce and display Your Content as necessary to operate and provide the Service, including transmitting it to AI providers. Where you post to the community feed, showcase or marketplace, you additionally grant us a license to display that content on the Service, and, if you opt in and it is approved, on our public pages, until you remove it. You represent that you have all rights necessary to submit Your Content and that doing so does not infringe or violate the rights of any person or any law.

6. Community, showcase and marketplace

Community posts, comments, profiles and embeds are visible to other users and, where you opt in, to the public. You are responsible for what you post. The marketplace permits users to list creations for bids and to specify the copyright terms (full transfer, exclusive license or non-exclusive license) that would apply on a successful sale. The Factual Library may facilitate introductions between buyers and sellers but is not a party to, and does not guarantee, any transaction between users. We make no representation as to the ownership or fitness of any listed item, and any transfer of rights or payment arranged outside the token system is solely between the users involved. Notepads are accessible to anyone with the notepad link unless a password is set, and you should not store sensitive information in them.

7. Intellectual property and copyright complaints

The Service, including its software, design and branding, is owned by us or our licensors and is protected by law. Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you. We respond to notices of alleged copyright infringement in accordance with our DMCA Policy.

8. Service availability and changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be unavailable because of maintenance, outages, capacity limits, failures of third-party providers or events beyond our reasonable control. Features, models, limits and modules may be added, changed, restricted or discontinued at any time, including on a per-account basis. Generation jobs are processed asynchronously and completion times are not guaranteed.

9. Suspension and termination

You may stop using the Service and request deletion of your account at any time. We may suspend, restrict or terminate your access, with or without notice, if we believe you have violated these Terms or applicable law, if required by law, or if continued provision of the Service is no longer commercially or technically feasible. On termination for violation, any unused token balance may be forfeited to the extent permitted by law. Sections that by their nature should survive termination will survive, including sections 2, 5, 7, 10, 11, 12 and 13.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Service and all Output are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or secure operation. We do not warrant that Output will be accurate, lawful, original or free from defects.

11. Limitation of liability

To the fullest extent permitted by law, The Factual Library and its owners, personnel, licensors and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Service or these Terms, whatever the legal theory and even if advised of the possibility of such damages. Our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid us for tokens in the three months preceding the event giving rise to the claim and one thousand Indian rupees. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to defend, indemnify and hold harmless The Factual Library and its owners and personnel from any claims, liabilities, damages and expenses, including reasonable legal fees, arising out of Your Content, your use of Output, your violation of these Terms, or your infringement of any right of a third party.

13. Changes to these Terms; general

We may amend these Terms from time to time. The revised Terms will be posted on this page with an updated date, and where a change is material we will provide additional notice. Continued use of the Service after the effective date of a revision constitutes acceptance. These Terms, together with the Privacy Policy and DMCA Policy, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.

14. Contact

Questions about these Terms may be sent to The Factual Library through the support and report function inside your account.
